"Can We Record This Conversation?"

This is the most common and most dangerous request. You are not legally required to give a recorded statement to the other driver's insurance company. Despite what they may imply, refusing a recorded statement will not hurt your claim.

Here's why recorded statements are dangerous:

  • You're speaking without full knowledge of your injuries. Many car accident injuries — whiplash, concussions, soft tissue damage — take days or weeks to fully manifest. If you say "I feel fine" on day two, that statement will be used against you when your injuries turn out to be serious.
  • Questions are designed to elicit damaging admissions. "How fast were you going?" "Did you see the other car before the impact?" "Were you looking at the road?" These seem straightforward but are crafted to establish fault or minimize your injuries.
  • Your words will be parsed and twisted. A casual "I think I might have been going a little over the limit" becomes "the claimant admitted to speeding" in the adjuster's notes.

What to Say Instead

You can provide basic factual information — your name, contact information, date and location of the accident, and that you are seeking medical treatment. Beyond that, politely decline: "I'm happy to cooperate, but I'd like to speak with an attorney before providing a formal statement."

The Quick Settlement Offer

The adjuster may offer you money within days of the accident. It will seem generous — maybe a few thousand dollars on top of your medical bills. But it's almost always a fraction of what your case is worth.

Why the rush? Because they know that once you accept a settlement, you sign away your right to seek any additional compensation. If your injuries turn out to be worse than expected, or you need surgery months later, you're out of luck.

The "Just a Few Questions" Approach

"I just need to ask a few quick questions to process your claim." These seemingly casual questions are designed to build a narrative that minimizes your injuries or shifts fault to you. Every answer is documented and can be used against you later.

Minimizing Your Injuries

  • "Our medical reviewer says your injuries are consistent with pre-existing conditions." Missouri law allows you to recover for aggravation of pre-existing conditions. Don't let them tell you otherwise.
  • "The treatment you received seems excessive for this type of injury." Your doctor determines your treatment, not an insurance adjuster with a financial incentive to minimize it.
  • "We see you were back at work within a week." Returning to work doesn't mean you're healed. Many injury victims push through pain because they can't afford to miss pay.

Shifting Fault to You

Missouri's pure comparative fault system means the insurance company benefits every time they can assign more fault to you. Common tactics:

  • "Our investigation shows you were partially at fault." Based on what evidence? They'll use your own statements, traffic camera footage, and police report details to build this argument.
  • "You should have seen the other driver coming." Imputing fault based on what you "should have" done is a standard tactic.
  • "Why didn't you brake sooner?" Second-guessing your split-second reaction to an unexpected hazard.

Social Media Surveillance

Adjusters will search your social media accounts. A photo of you smiling at a family gathering, a check-in at a restaurant, or a status update about feeling better can all be taken out of context to argue your injuries aren't serious.

Rule of thumb: Set all social media to private and do not post anything about your accident, injuries, or recovery.

What You Should Do Instead

1. Let Your Attorney Handle Communications
